Divorce in Pakistan
Divorce in Pakistan refers to the legal termination of marriage through various means, including Khula (by the wife), Talaq (by the husband), and judicial divorce. The country's laws ensure that divorce proceedings follow Islamic principles while maintaining legal protection for both parties. In addition to Khula and Talaq, judicial divorce can be granted under Section 2 of the Dissolution of Muslim Marriages Act 1939, which allows a woman to seek divorce on specific grounds such as cruelty, desertion, or impotence of the husband.
Once a divorce is finalized, both parties must ensure proper documentation to avoid future legal complications. After the divorce is legally effective, the divorced woman must observe the Iddat period, which lasts 90 days or three menstrual cycles. After this period, she is free to remarry.
