Khula in Pakistan

Khula is the legal right of a Khula in Pakistan to seek a divorce from her husband through the court. It is an Islamic provision that allows a woman to dissolve her marriage if she is unable to continue living with her husband due to irreconcilable differences. The process of Khula is governed by the Family Courts Act 1964, which enables a wife to file a suit for dissolution of marriage. If the court is satisfied with the reasons provided, it grants a Khula decree, officially ending the marital relationship.

The legal process of Khula requires the wife to submit an application to the Family Court, outlining the reasons for seeking divorce. During the proceedings, the court attempts reconciliation between the couple. If reconciliation efforts fail, the court proceeds with the Khula decree. In most cases, the wife is required to return the Haq Mehr (dower) or any other benefits received from the husband, as per Islamic law. Once the decree is issued, the Union Council registers the dissolution, making it legally binding.
