Talaq in Pakistan

Talaq is the Islamic right of a Muslim husband to divorce his wife in Pakistan. It is a unilateral form of divorce initiated by the husband, following the guidelines of Islamic Shariah and Pakistani family laws. According to the Muslim Family Laws Ordinance 1961, a husband can pronounce Talaq either orally or in writing. However, he must send a written notice to the Union Council and provide a copy to his wife. This initiates the legal process of divorce.

Upon receiving the Talaq notice, the Union Council appoints an Arbitration Council to attempt reconciliation between the husband and wife. If reconciliation fails within 90 days, the divorce becomes legally effective, and the Union Council issues a Talaq certificate. It is important to follow this legal procedure, as failure to notify the Union Council can result in the Talaq being considered invalid under Pakistani law.
